  《广东省民办社会福利机构管理规定》已经2017年2月17日广东省人民政府第十二届96次常务会议修订通过,现予公布,自2017年8月1日起施行。

  The Provisions of Guangdong Province on the Administration of Private-run Social Welfare Entities adopted by the 96th Executive Meeting of the 12th Session of the People’s Government of Guangdong Province on February 17, 2017 are hereby promulgated and shall become effective as of August 1, 2017.

  Social Welfare Entities


  第一章 总 则

  Chapter I General Provisions

  第一条 为规范民办社会福利机构的管理,维护民办社会福利机构及其服务对象的合法权益,促进社会福利事业的发展,根据有关法律、法规,结合本省实际,制定本规定。

  Article 1

  These Provisions are formulated for the purposes of regulating the administration of private-run social welfare entities, safeguarding the legitimate rights and interests of private-run social welfare entities and their service-recipients, and promoting the development of social welfare undertakings in accordance with relevant laws and regulations and in light of the actual situation of this Province.

  第二条 本规定适用于自然人、法人或者其他组织利用非国有资产在本省行政区域内举办的,登记为社会服务机构法人或者企业法人,为老年人、残疾人、孤儿和弃婴等特殊群体提供集中居住、生活照料和康复教育服务的机构。

  Article 2

  These Provisions shall apply to the entities that are operated by natural persons, legal persons or other organizations within the administrative region of this Province using non-state-owned assets, and are registered as social-service legal persons or enterprise legal persons, providing centralized residence, nursing care and rehabilitation education services for special groups such as the elderly, the disabled, orphans and abandoned infants.

  第三条 县级以上人民政府民政部门是民办社会福利机构的业务主管部门,负责本行政区域内民办社会福利机构的监督管理工作。

  Article 3

  Civil affairs departments of people’s governments at the county level or above shall be the competent authorities in charge of the affairs relating to private-run social welfare entities, and shall be responsible for the supervision and regulation of the private-run social welfare entities within their respective administrative regions.

  发展改革、公安、财政、人力资源社会保障、国土资源、住房城乡建设、城乡规划、商务、卫生计生、工商、食品药品监管等部门,按照各自职责,做好民办社会福利机构的管理工作。

  Such authorities as departments of development and reform, public security, finance, human resources and social security, land and resources, housing and urban-rural development, urban-rural planning, commerce, health and family planning, industry and commerce, and food and drug supervision shall, in light of their respective functions and duties, properly carry out the administration of private-run social welfare entities.

  第四条 鼓励自然人、法人或者其他组织依法举办社会福利机构,支持民办社会福利机构的发展。

  Article 4 

  Natural persons, legal persons and other organizations are encouraged to establish and operate social welfare entities in accordance with law, and the development of the private-run social welfare entities shall be supported.

  民办社会福利机构按照国家和本省规定享受扶持和优惠政策。

  Private-run social welfare entities shall be entitled to the support and preferential policies specified by relevant national and provincial provisions.

  第五条 对民办社会福利事业作出突出贡献的单位和个人,依照国家有关规定给予表彰和奖励。

  Article 5

  The units or individuals that make outstanding contributions to private-run welfare undertakings shall be commended and rewarded in accordance with relevant national provisions.

  第二章 机构设立、变更与终止

  Chapter II Establishment, Alteration and Termination of Private-run Social Welfare Entities

  第六条 举办民办社会福利机构,应当符合下列条件:

  Article 6 

  The establishment of a private-run social welfare entity shall be subject to the following conditions:

  (一)有自己的名称、住所和章程;

  (1) The proposed entity shall have its own name, domicile and articles of association;

  (二)有与服务内容和规模相适应的资金;

  (2) The proposed entity shall have funding that is commensurate with the content and scale of the services that it plans to offer;

  (三)有符合相关资格条件的管理人员、专业技术人员和服务人员;

  (3) The proposed entity shall have managers, professional technicians and service personnel who meet the relevant qualification requirements; and

  (四)有基本的生活用房、设施设备和活动场地;

  (4) The proposed entity shall have necessary living quarters, supporting facilities and venues for holding activities; and

  (五)法律、法规规定的其他条件。

     (5) Other conditions as may be prescribed by laws and regulations.

  民办社会福利机构应当配备与机构开展服务相适应的工作人员。直接服务于服务对象的工作人员数与入住的自理服务对象人数比例达到1∶10以内,与介助服务对象人数比例达到1∶6以内,与介护服务对象人数比例达到1∶3以内,与儿童服务对象人数比例达到1∶1以内。服务对象超过200人的应当至少有1名专职营养师。

  A private-run social welfare entity shall be staffed with employees as are appropriate for the services that the entities intend to offer. The ratio between the number of its employees who directly serve its service-recipients and that of the service-recipients who are capable of taking care of themselves shall be higher than 1:10, the ratio between such employees and device-aided service-recipients shall be higher than 1:6, the ration between such employees and the nursing-cared service-recipients shall be higher than 1: 3, and the ration between such employees and child service-recipients shall be higher than 1:1. If the number of service-recipients exceeds 200, at least one full-time dietitian shall be available. 

  第七条 举办公益性民办社会福利机构,应当依照社会服务机构登记管理规定到民政部门办理登记;举办经营性民办社会福利机构,应当依照工商登记管理有关规定到工商行政管理部门办理登记。

  Article 7

  The establishment of a private-run social welfare entity with the nature of public interest shall be subject to registration with the competent civil affairs department in accordance with the registration and administration regulations for social service entities; the establishment of a private-run social welfare entity with the nature of public interest shall be subject to registration with the competent administration for industry and commerce in accordance with relevant provisions on the registration of industrial and commerce.

  公益性民办社会福利机构应当符合下列条件:

  A private-run social welfare entity with the nature of public interest shall meet the following conditions:

  (一)以为老年人、残疾人、孤儿和弃婴提供集中居住、生活照料和康复教育服务为宗旨,且不以营利为目的;

  (1) It is established for the purposes of providing centralized housing, nursing care and rehabilitation education services for the elderly, the disabled, orphans and abandoned infants, and is not for profit;

  (二)不得经营与其设立目的无关的业务;

  (2) It may not engage in any business unrelated to the purpose of its establishment;

  (三)有健全的财务会计制度;

  (3) It shall have a sound financial accounting system;

  (四)全部资产及其增值为该机构所有;

  (4) All its assets and any added values thereof shall be owned by the entity;

  (五)收益和营运结余主要用于符合该机构设立目的的事项;

  (5) Balances of its income and operation revenues shall be primarily used for matters consistent with the purpose of establishment of the entity;

  (六)捐赠者不以任何形式参与该机构财产的分配;

  (6) Its donors may not participate in the distribution of the property of the entity in any way;

  (七)终止后的剩余财产不归属任何个人或者营利组织;

  (7) Where the entity is terminated, all its remaining property after such termination shall not be vested in any individual or profit-making organization; and

   (八)法律、法规规定的其他条件。

  (8) Other conditions as may be prescribed by laws and regulations.

  第八条 香港、澳门的组织、个人独资或者采取合资、合作的形式,在本省举办社会福利机构的,应当向所在地的县级人民政府登记主管部门或者不设区的地级以上市人民政府登记主管部门提出申请。

  Article 8

  Where any organization or individual from the Hong Kong SAR or the Macao SAR that intends to establish and operate a social welfare entity in this Province, whether in the form of a sole proprietorship or a joint venture, such individual or organization shall apply to the competent registration department of the local people’s governments at the county level (or the local municipal people’s government which is not divided into districts, as the case may be) in which the entity is to be located.

  台湾地区的组织、个人以及华侨、外国的组织、个人独资或者采取合资、合作的形式,在本省举办社会福利机构的,应当向省人民政府登记主管部门提出申请。

  Where any organization or individual from the Taiwan Area as well as any overseas Chinese or foreign citizen or organization intends to establish and operate a social welfare entity in this Province, whether in the form of an individual proprietorship or joint venture, such individual or organization shall apply to the registration authority of the provincial People’s Government.

  第九条 未经依法登记设立,任何组织和个人不得以民办社会福利机构名义收住老年人、残疾人、孤儿和弃婴等服务对象。

  Article 9

  No organization or individual without going through the registration and establishment formalities in accordance with law may take in the resident service recipients such as the elderly, disabled persons, orphans and abandoned infants in the name of a private-run social welfare entity.

  第十条 民办社会福利机构变更登记事项,应当按照申办程序向有关部门办理变更手续。

  Article 10

  Where a private-run social welfare entity alters any of its registration information, it shall go through a modification procedure with the competent authority in accordance with the application procedure for establishing the entity.

    法律法规另有规定的,从其规定。

  Where there are other provisions in the laws or regulations, such provisions shall prevail.

  第十一条 民办社会福利机构因变更或者终止等原因暂停、终止服务的,应当于暂停或者终止服务60日前,向登记地的民政部门提交服务对象安置方案。安置方案应当明确收住人员的数量、安置计划及实施日期等事项,经批准后方可实施。在妥善安置好服务对象后,按照申办程序向有关部门提出申请并经核准,方能停止服务。

  Article 11

  Where a private-run social welfare entity suspends or terminates its services on the ground of modification or termination, it shall, 60 days prior to the suspension or termination of such services, submit a plan for the resettlement of the service recipients of the entity to the civil affairs department in the administrative region where the entity is registered. The resettlement plan shall specify such items as the number of such service recipients, the plan for their resettlement and the timetable for their resettlement. The plan may not be implemented before it is duly approved. The services may not be suspended or terminated until the service recipients are properly resettled and the application for such suspension or termination is submitted to the competent authority in accordance with the application procedure for establishing the entity.

  民政部门应当自收到安置方案之日起20日内完成审核工作。

  The civil affairs department shall complete the review of the resettlement plan within 20 days from the date of the receipt.

  民政部门应当督促民办社会福利机构实施安置方案,并为其妥善安置服务对象提供帮助。

  The civil affairs department shall ensure that the private-run social welfare entity properly carries out the resettlement plan and provide it with assistance in connection with the proper resettlement of the service recipients of the entity.

  第十二条 民办社会福利机构的登记机关应当依法公开民办社会福利机构的设立、变更和终止信息。

  Article 12

  The registration authority for private-run social welfare entities shall, in accordance with law, disclose information on the establishment, modification and termination of private-run social welfare entities.

  第三章 监督管理

  Chapter III Supervision and Regulation

  第十三条 民办社会福利机构应当按照国家有关规定制定服务标准和工作流程并向社会公开,建立健全安全、消防、卫生、财务、档案管理等制度。

  Article 13

  The private-run social welfare entity shall, in accordance with relevant national provisions, formulate service standards and work procedures and disclose them to the public, and establish and improve such systems as safety, fire prevention, health, finance and archive management.

  第十四条 民办社会福利机构应当按照国家和省的有关规定,并根据其登记类型、设施设备条件、管理水平、服务质量以及服务对象的护理等级等因素确定服务项目和收费标准。

  Article 14

  The private-run social welfare entity shall, in accordance with relevant national and provincial provisions, determine the types of service it offers and the rates thereof on the basis of the category that the entity is registered as, its facilities and equipment, management capability, quality of service and the level of nursing required by its service recipients.

  民办社会福利机构应当在办公场所显著位置或者通过机构网站公示各类服务项目的服务内容、收费标准及收费依据,接受社会监督。

  A private-run social welfare entity shall display information on the content of its services, the rates of service fees and the basis thereof at a readily visible place in its office or via its official website, so as to subject such information to public supervision.

  民办社会福利机构不得实行直至服务对象死亡的一次性全包式收费。

  A private-run social welfare entity may not offer a flat rate for services that are offered to a service recipient until the death thereof.

  第十五条 民办社会福利机构应当与服务对象(代理人、监护人)签定服务协议。

  Article 15

  A private-run social welfare entity shall conclude a service agreement with its service recipient (the agent or guardian thereof, as the case may be).

  服务协议应当载明以下内容:

  The service agreement shall include the following information:

  (一)民办社会福利机构的名称、住所、法定代表人或者主要负责人、联系方式;

  (1) Name, domicile, legal representative or principal person-in-charge of the entity as well as the contact information thereof;

  (二)服务对象(代理人、监护人)的姓名、身份证号码、住址及联系方式,监护人为单位的应当载明其名称、住所、法定代表人或者主要负责人、联系方式;

  (2) Name, identity card number, residential address and contact information of the service recipient (the agent or guardian thereof, as the case may be); where the guardian of the service recipient is an entity, the name, domicile, legal representative or principal person-in-charge of such entity as well as the contact information shall also be included;

  (三)服务项目和服务内容;

  (3) Items and content of the services;

  (四)收费标准和费用支付方式;

  (4) The rate of service fees and method of payment thereof;

  (五)服务期限和服务场所;

  (5) The term and venue of the services;

  (六)协议变更、解除及终止的条件;

  (6) Conditions for the alteration, rescission and termination of the agreement;

  (七)违约责任;

  (7) Liability for breach of agreement;

  (八)意外伤害责任认定和争议解决方式;

  (8) The identification of liability for accidental injuries and resolution of disputes;

  (九)免责条款;

  (9) Exemption clauses; and

  (十)当事人协商一致的其他事项。

  (10) Other matters that the parties have agreed upon.

  第十六条 各级人民政府及民政部门不得将城市生活无着的流浪乞讨人员委托民办社会福利机构收住。

  Article 16

  People’s governments at all levels and the civil affairs departments thereof may not entrust urban vagrants and beggars who cannot support themselves to any private-run social welfare entity.

  民办社会福利机构不得擅自收住城市生活无着的流浪乞讨人员。

  Without prior authorization, private-run social welfare entities may not take in any urban vagrants or beggars who cannot support themselves.

  第十七条 自然人、法人或者其他组织举办以孤儿、弃婴为服务对象的社会福利机构,应当与所在地县级以上人民政府民政部门共同举办。

  Article 17

  Where a natural person, legal person or any other organization intends to establish a social welfare entity that serves orphans or abandoned infants, such social welfare entity shall be jointly established and operated in conjunction with the civil affairs department of the local people’s government at the county level or above.

  民办社会福利机构不得直接从社会接收查找不到生父母或者其他监护人的孤儿和弃婴。需要收住孤儿或者弃婴的,应当经举办地县级以上人民政府民政部门逐一审核批准,并签订代养协议。

  The private-run social welfare entities may not directly accept from the public any orphans or abandoned infants whose biological parents or any other guardians thereof cannot be traced. Where it is justifiably necessary for a private-run social welfare entity to accept an orphan or abandoned infant, such acceptance shall be reviewed and approved by the civil affairs department of the people’s governments at the county level or above on a case-by-case basis and a foster care agreement shall be concluded thereon.

  第十八条 民办社会福利机构应当按照工作规范、服务标准和协议约定内容提供服务,不得歧视、侮辱、虐待、遗弃服务对象,不得侵犯服务对象的合法权益。

  Article 18

  Private-run social welfare entities shall provide services in accordance with their codes of conduct, service standards and the terms and conditions in the service agreement, and may not discriminate against, insult, abuse or abandon any service recipients, and may not infringe upon the legitimate rights and interests of any service recipients.

  第十九条 民办社会福利机构应当就消防等涉及服务对象人身安全的重要事项建立风险防控机制,制定应急预案。发生生产安全事故时,民办社会福利机构应当采取措施防止危害扩大,并立即向民政、公安、安全监管等部门报告。

  Article 19

  Private-run social welfare entities shall establish a mechanism of risk prevention and control for such important matters involving the personal safety of the service recipients as fire prevention, and formulate a corresponding contingency plan. When a work safety accident occurs at a private-run social welfare entity, the private-run social welfare entity shall take measures to prevent the expansion of the loss caused by such accident, and promptly report to the competent departments of civil affairs, public security, safety supervision and others.

  鼓励民办社会福利机构建立机构责任风险防范机制,投保机构责任保险。鼓励保险公司承保民办社会福利机构责任保险。

  Private-run social welfare entities are encouraged to establish risk prevention mechanisms for institutional liability, and purchase institutional liability insurance. Insurance companies are encouraged to underwrite the institutional liability insurance of private-run social welfare entities.

  第二十条 民办社会福利机构应当就食品安全、传染病等严重影响服务对象健康和生命安全的重要事项建立风险防控机制,制定应急预案。发生公共卫生事件时,民办社会福利机构应当采取措施防止危害扩大,并立即向民政、卫生计生、食品药品监管等部门报告。

  Article 20

  Private-run social welfare entities shall establish a mechanism of risk prevention and control for such important matters that may seriously affect the health and personal safety of the service recipients as food safety and infectious diseases, and formulate a corresponding contingency plan thereon. In the event of a public health incident, the private-run social welfare entity involved shall take measures to prevent the expansion of the loss caused by such incident, and promptly report to the competent departments of civil affairs, health and family planning, food and drug administration and others.

  收住服务对象死亡的,民办社会福利机构应当立即通知其家属(代理人、监护人),并向民政、公安等部门报告。

  Where a service recipient dies, the private-run social welfare entity involved shall promptly notify the family (agent or guardian thereof, as the case may be), and file a report to the competent departments of the civil affairs, public security and others.

  鼓励民办社会福利机构与周边医疗卫生机构建立协议合作机制。鼓励具备条件的民办社会福利机构依法开办相关的医疗卫生机构。鼓励符合条件的医疗卫生机构与民办社会福利机构建立合作共建机制。鼓励执业医师到民办社会福利机构依法开办的医疗卫生机构多点执业。

  Private-run social welfare entities are encouraged to establish a contractual cooperation mechanism with nearby medical and health institutions. Private-run social welfare entities with the requisite conditions are encouraged to operate relevant medical and health care institutions in accordance with law. Medical and health care institutions with the requisite conditions are encouraged to establish a cooperative construction mechanism with private-run social welfare entities. Medical practitioners are encouraged to practice, on a concurrent basis in accordance with law, at medical and health care institutions operated by the private-run social welfare entities.

  第二十一条 民办社会福利机构应当依法与其直接招用的工作人员签订劳动合同,并依法参加社会保险,保护工作人员的合法权益。

  Article 21 

  Private-run social welfare entities shall, in accordance with law, enter into employment contracts with the employees directly recruited by them, and enroll such employees in social insurance plan in accordance with law so as to protect the legitimate rights and interests of the employees.

  民办社会福利机构因业务需要使用劳务派遣用工的,按照国家有关劳务派遣规定执行。

  Where it is necessary for a private-run social welfare entity to employ any employee through the labor dispatch service, the relevant national provisions on labor dispatch shall apply.

  第二十二条 公益性民办社会福利机构应当在每年3月底前,向登记地的民政部门和同级价格主管部门报送上一年度工作报告和由具有审计资格的第三方审计的财务会计报告。报告内容应当包括机构年度运营管理情况、财产管理使用情况、服务项目范围和质量实施情况以及工作人员的工资福利、社会保险情况等。

  Article 22

  A private-run social welfare entity with the nature of public interest shall, before the end of March of each year, submit its annual work report and annual financial report audited by a qualified third-party auditing service provider to the civil affairs department in the administrative region where the entity is registered, as well as the price regulatory department at the same level as the civil affairs department. The above-mentioned reports shall cover such matters as the annual operation management of the entity, property use and management, the scope of its services and the quality thereof, as well as the wages and welfare of its employees and their participation in social security plan.

  民政部门应当通过适当形式将前款两项报告向社会公布,接受社会监督。

  The civil affairs department shall disclose the two reports mentioned in the preceding paragraph to the public in an appropriate way and subject them to the public supervision.

  第二十三条 县级以上人民政府民政部门应当每年通过书面审查或者实地查验等方式对民办社会福利机构进行监督检查,并向社会公布检查结果。

  Article 23

  The civil affairs departments of the people’s governments at the county level or above shall supervise and inspect the private-run social welfare entities within their respective administrative region by documents or on-site inspections, and shall disclose the inspection results to the public.

  民政部门应当建立评估制度,定期对民办社会福利机构的人员、设施、服务、管理、信誉等情况进行综合评价,并向社会公布评估结果。评估工作可以委托第三方实施。

  The civil affairs departments shall establish an evaluation system, comprehensively evaluating the personnel, facilities, services, management and reputation of the private-run social welfare entities, and the evaluation results shall be disclosed to the public. Such evaluation work may be commissioned to a third party.

  县级以上人民政府民政部门应当建立民办社会福利机构及其主要负责人信用记录制度,并向社会公布。

  The civil affairs departments of the people’s governments at the county level or above shall establish a credit record system of the private-run social welfare entities and principal persons-in-charge thereof, and shall disclose such records to the public.

  各级残疾人联合会对民办社会福利机构为残疾人提供服务依法进行业务指导。

  The China Disabled Persons’ Federations at all levels shall provide operational guidance to the private-run social welfare entities in connection with services provided to the disabled.

  第二十四条 任何单位和个人对民办社会福利机构的违法行为,可以向民政等部门投诉举报,民政等部门应当及时受理并依法处理。对属于其他部门主管的事项,民政等部门应当及时将投诉举报转有关部门处理,并及时告知投诉举报人。

  Article 24

  Any unit or individual may file a complaint to the civil affairs department against any wrongful conduct of any private-run social welfare entity, and the civil affairs department concerned shall promptly accept and deal with such complaints and reports in accordance with law. Where the matter complained against is within the authority of other departments, the civil affairs department concerned shall timely forward such complaints and reports to the competent department and shall timely inform the complainants and reporters.

  民政部门应当建立健全投诉举报机制,畅通投诉举报渠道,采取公开投诉举报电话、电子邮箱、网络平台等方式,方便社会公众投诉举报。

  The civil affairs departments shall establish and improve its complaint filing mechanism, expedite the channels for filing complaints and reports, and adopt such measures as publicly designating telephone numbers, electronic mail addresses and online platforms for receiving complaints and reports, so as to facilitate the public to file complaints and reports.

  第四章 优惠扶持

  Chapter IV Preferential Support

  第二十五条 县级以上人民政府及其有关部门应当对举办民办社会福利机构给予鼓励、扶持,具体扶持政策由县级以上人民政府另行制定。

  Article 25

  People’s governments at the county level or above and relevant departments thereof shall encourage and support the establishment of private-run social welfare entities, and the corresponding support policies shall be specifically formulated by the people’s governments at the county level or above.

  第二十六条 各级人民政府应当根据城乡规划布局要求,将民办社会福利机构的社会福利设施用地纳入土地利用年度计划。新建民办社会福利机构的社会福利设施用地申报新增建设用地,符合土地利用总体规划和城乡规划的,应当在土地利用年度计划中优先安排。

  Article 26

  People’s governments at all levels shall, in accordance with the requirements of urban-rural planning, incorporate the land used for social welfare facilities of the private-run social welfare entities into the annual land use plans. Where a newly established private-run social welfare entity applies for any additional land for such purpose, the application shall be given priority in the annual land use plan if such application meets the overall plan of land use and urban and rural planning program.

  政府依法收回的闲置土地,规划用途符合要求的,可以优先用于民办社会福利机构的社会福利设施用地。

  The idle land lots recovered by the government in accordance with law may be given priority to the land use for social welfare facilities of the private-run social welfare institutions where its planning purpose meets the requirement.

  第二十七条 公益性民办社会福利机构的社会福利设施用地可以采取划拨方式供应;变更为经营性民办社会福利机构的,其通过划拨方式取得的用地应当报县级以上人民政府批准并办理协议出让或者租赁土地手续,补缴土地出让金或者租金,但是法律法规规章和原《国有建设用地划拨决定书》规定应当收回划拨建设用地使用权的除外。

  Article 27

  The land used for social welfare facilities of a private-run social welfare entity with the nature of public interest may be supplied by way of land allocation; where the private-run social welfare entity with the nature of public interest is transformed into a for-profit social welfare entity, the land that it obtains by way of land allocation shall be reported to the people’s governments at the county level or above for approval, and the entity shall complete the contractual transfer or lease procedure for such land, and pay all the land transfer fees or rent, unless the laws, regulations and rules and the Land Allocation Decision on State-owned Construction stipulate that the right to use the allocated land shall be withdrawn.

  经营性民办社会福利机构的社会福利设施用地应当以租赁、出让等有偿方式供应,原则上以租赁方式为主。土地出让或者租赁计划公布后,同一宗社会福利设施用地有两个或者两个以上用地申请人的,应当以招标、拍卖或者挂牌方式供地。以招标、拍卖或者挂牌方式供地时,不得设置要求竞买人具备相应资质、资格等影响公平公正竞争的限制条件。

  The land used for social welfare facilities of the for-profit private-run social welfare entities shall be supplied on a payable basis, such as in the form of land lease or transfer, and in principle, primarily in the form of land lease. After the land transfer or lease plan is disclosed to the public, and if it is found there are two or more bidders for the same land lot to be used for social welfare facilities, the user of the land lot shall be decided by way of bidding, auction or listing on a land trading platform. Where the land lot is supplied by way of bidding, auction or listing on a land trading platform, no such restrictive conditions as the bidder’s specific qualification or eligibility which may affect fair competition shall be imposed on the bidders. 

  第二十八条 已建成住宅小区内增加公益性民办社会福利机构的社会福利设施用地,符合用地规划的,可以不增收土地价款;变更为经营性民办社会福利机构的,应当补缴相应土地价款。

  Article 28

  Where a land lot is needed in a developed residential community for social building welfare facilities of a private-run social welfare entity with the nature of public interest, and such land lot is in line with relevant land use planning, additional land transfer payment for such land lot may be exempted; where the private-run social welfare entity with the nature of public interest is transformed into a for-profit social welfare entity, the additional land transfer price shall be paid.

  第二十九条 对公益性民办养老机构建设免征行政事业性收费,对经营性民办养老机构建设减半收取行政事业性收费。

  Article 29

  Administrative fees and charges on public undertakings shall be exempted for the private-run nursing entities with the nature of public interest for the elderly and those on for-profit private-run nursing entities for the elderly shall be charged at the half price of the original rates.

  民办养老机构用水、用电、用气收费按照居民生活类价格执行。

  The fees payable by private-run nursing entities for the elderly for supplies of water, electricity and gas shall be paid according to the rates applicable to the daily life of residents.

  公益性民办养老机构免收固定电话、有线(数字)电视、宽带互联网一次性接入费用,减半收取有线(数字)电视的基本收视维护费和固定电话月租费。

  The fees payable for fixed-line telephone service, cable (digital) television, and one-time connection to broadband internet shall be exempted for the private-run nursing entities with the nature of public interest for the elderly, and the basic maintenance fee and fixed-line telephone service fee shall be paid at half the original rates thereof.

  第三十条 民办社会福利机构按照国家税收法律规定享受税收优惠政策。

  Article 30

  Private-run social welfare entities shall enjoy preferential tax policies in accordance with the provisions of national tax laws.

  第三十一条 民办社会福利机构聘用的专业技术人员,在技术职称评定、继续教育、职业技能培训等方面与公办社会福利机构同类人员享受同等待遇。

  Article 31

  The professional and technical personnel employed by private-run social welfare entities shall be entitled to the same treatment as employees of public social welfare entities in terms of application for professional titles, continuing education, and professional expertise training and so on.

  第三十二条 县级以上人民政府民政部门可以就下列常住对象的生活照料、康复教育等向本行政区域内的民办社会福利机构购买社会福利服务:

  Article 32

  Civil affairs departments of the people’s governments at the county level or above may purchase social welfare services from private-run social welfare entities within their administrative regions for the purposes of the residential care and rehabilitation education for the following resident groups:

  (一)无劳动能力、无生活来源、无法定赡养抚养扶养义务人或者其法定义务人无履行义务能力的居民;

  (1) Residents who have no work ability, no source of livelihood, and have no person who is legally obliged to support them or those who are legally obliged to support them are unable to fulfill the obligation;

  (二)纳入当地最低生活保障的人员;

  (2) Persons who are included in the local minimum living security scheme;

  (三)低收入家庭中60周岁及以上的失能老人;

  (3) The elderly members aged 60 or above of low-income households who have become disabled;

  (四)80周岁及以上的高龄老人;

  (4) The senior citizens aged 80 or above;

  (五)失能的市级以上劳动模范;

  (5) The model workers at the municipal level or above who have become disabled;

  (六)孤老优抚对象;

  (6) The recipients of the preferential treatment for the childless elderly;

  (七)四级及以上残疾军人;

  (7) Disabled soldiers with disabilities at Grade IV or above; and

  (八)一、二级重度残疾人。

  (8) Disabled persons with severe disabilities at Grade I or Grade II.

  有条件的地区,可以适当扩大纳入购买社会福利服务对象的范围,具体由当地人民政府确定。

  Regions with the required conditions may appropriately expand the scope of resident groups for whom social welfare services are purchased by the government. Such expansion shall be determined by the local people’s government.

  第三十三条 民办社会福利机构不得改变其主要场地和设施的用途。改变用途的,应当按照国家有关规定办理相关手续,不再享受相关的优惠政策。

  Article 33

  Private-run social welfare entities may not change the purposes for which their main venues and facilities are used. Where any of the purposes is changed, they shall go through relevant formalities in accordance with relevant national provisions, and in such circumstance, such entities shall cease to be eligible for the corresponding preferential policies.

  第五章 法律责任

  Chapter V Legal Liability

  第三十四条 民办社会福利机构有下列行为之一的,由县级以上人民政府民政部门责令改正;情节严重的,可以处3万元以下罚款;涉嫌犯罪的,移送司法机关依法处理:

  Article 34

  Where a private-run social welfare entity commits any of the following acts, the civil affairs department of the people’s governments at the county level or above shall order it to make corrections; where the circumstances of such offenses are serious, a fine of less than 30,000 yuan may be imposed; and where the entity is suspected of committing a crime, it shall be referred to the competent judicial authority for prosecution in accordance with law:

  (一)未与服务对象(代理人、监护人)签订服务协议,或者协议不符合规定;

  (1) Failing to conclude a service agreement with the service recipients (agents or guardians), or the agreement is not in conformity with relevant provisions;

  (二)未按照国家有关标准和规定开展服务,或者未按照与服务对象(代理人、监护人)约定的标准提供服务;

  (2) Failing to carry out the services in accordance with relevant national standards and provisions, or failing to provide services in accordance with the standards agreed on with the service recipients (agents or guardians);

  (三)擅自收住孤儿、弃婴或者城市生活无着的流浪乞讨人员;

  (3) Taking in any orphan, abandoned infant, or urban vagrant or beggar that cannot support himself without proper authorization; 

  (四)未按照规定配备人员;

  (4) Failing to staff the institution in accordance with relevant provisions;

  (五)在审批、登记或者存续期间,向民政部门隐瞒有关情况、提供虚假材料或者拒绝提供反映其活动情况的真实材料;

  (5) Hiding any of the requisite information from the civil affairs department during the examination and approval, registration or existence of the entity, or providing false materials or refusing to provide truthful materials indicating the circumstances of its activities;

  (六)利用社会福利机构的房屋、场地、设施开展与服务宗旨无关的活动;

  (6) Using the housing, venue and facilities of the entity for any activity unrelated to the purpose of the services of the entity;

  (七)未按照规定建立安全生产和公共卫生风险防控机制,制定应急预案;

  (7) Failing to establish the risk prevention and control mechanism of work safety and public health in accordance with relevant provisions, and failing to formulate the emergency plan thereon;

  (八)未按照规定向有关部门报告生产安全事故、公共卫生事件、收住服务对象死亡情况;

  (8) Failing to report any work safety accident, public health incident, or the death of any service recipient to the administrative departments concerned in accordance with relevant provisions;

  (九)歧视、侮辱、虐待、遗弃服务对象,或者存在其他侵犯服务对象合法权益的行为;

  (9) Discriminating against, insulting, abusing or abandoning any of its service recipients or committing any other conducts that infringe upon the legitimate rights and interests of any service recipient;

  (十)擅自暂停或者终止服务;

  (10) Suspending or terminating the service without proper authorization; or

  (十一)发生重大安全责任事故。

  (11) Having occurred any major safety accident.

  第三十五条 任何组织和个人未经依法登记设立,擅自以民办社会福利机构名义收住老年人、残疾人、孤儿和弃婴等服务对象的,由登记管理机关依照有关法律法规处罚。

  Article 35 

  Any organization or individual that fails to be registered and established in accordance with law, and takes in such service recipients as the elderly, the disabled, orphans and abandoned infants in the name of a private-run social welfare entity shall be punished by the registration administrative authority in accordance with relevant laws and regulations.

  第三十六条 民政部门及其工作人员在对民办社会福利机构审批和监管中滥用职权、玩忽职守、徇私舞弊的,由上级机关责令改正;造成严重后果的,对直接负责的主管人员和其他直接责任人员依法给予处分;涉嫌犯罪的,移送司法机关依法处理。

  Article 36

  Where a civil affairs department or any staff member thereof abuses powers, neglects duties, or commits illegalities for personal gains in the examination, approval and regulation of the private-run social welfare entities, the authorities at the higher level shall order them to make corrections; where their conduct causes any serious consequence, the person(s) directly in charge and other persons directly responsible shall be imposed sanctions in accordance with law; where such person (s) are suspected of committing any crime, they shall be referred to the competent judicial authority for prosecution in accordance with law..

  其他行政管理部门及其工作人员违反本规定的,由其上级行政机关责令改正;情节严重的,依法追究相关人员责任;涉嫌犯罪的,移送司法机关依法处理。

  Where other administrative departments or any staff member thereof violates these Provisions, they shall be ordered by the administrative departments at the higher level to make corrections; where the circumstances are serious, the relevant personnel shall be held accountable in accordance with law; and where they are suspected of committing any crime, they shall be referred to the competent judicial authority for prosecution in accordance with law.

  第六章 附 则

  Chapter VI Supplementary Provisions

  第三十七条 本规定自201781日起施行。广东省人民政府2009310日公布的《广东省民办社会福利机构管理规定》(广东省人民政府令第133号)同时废止。

  Article 37

  These Provisions shall become effective as of August 1, 2017. The Provisions of the Guangdong Province on the Administration of Private-run Social Welfare Institutions promulgated by the People’s Government of Guangdong on March 10, 2009 (Decree of the People’s Government of Guangdong Province No. 133) shall be repealed simultaneously.
